Promotion of Access to Information Act 2, 2000 — Section 51 Manual

1. Introduction
This manual is published in terms of Section 51 of the Promotion of Access to Information Act, 2000 (“PAIA”) and Section 18 of the Protection of Personal Information Act, 2013 (“POPIA”). It provides information on how to request access to records held by B&W Productions (Pty) Ltd (“B&W Productions”, “we”, “us”, “our”).

4. Guide on How to Use PAIA

5. Records Held by B&W Productions
The categories of records held by B&W Productions include, but are not limited to:
- Company records: founding documents, registration certificates, annual returns, internal policies and procedures
- Financial records: annual financial statements, tax returns, banking records, invoices and accounts
- Client and supplier records: contracts, correspondence, event briefs, quotations, invoices and payment records
- Personnel records: employment contracts, payroll information, performance records, disciplinary records
- Operational records: event production documentation, venue information, supplier lists, logistics planning
- Marketing records: website content, email marketing lists, social media content, client testimonials
- IT and digital records: website analytics, contact form submissions, system logs
Not all records are automatically available. Access is subject to the grounds of refusal set out in PAIA and any applicable legislation.
6. How to Request Access to Records
A request for access to a record must be made on the prescribed form (Form C for a private body), available from the SAHRC website or the Department of Justice and Constitutional Development website. The completed form must be submitted to our Information Officer at the contact details in Section 3 above.
Your request must provide sufficient detail to identify the record(s) you require, the form of access requested, and your postal or email address for correspondence. An identity document or proof of authority (if acting on behalf of another person) must accompany your request.
7. Fees
The following fees may apply in terms of Section 54 of PAIA:
- Request fee: a non-refundable fee is payable on submission of a request for access (currently R50)
- Access fee: an additional fee may be payable for the search, preparation, and reproduction of the record, calculated in accordance with the prescribed tariffs published by the Minister
You will be notified of any applicable access fee before the record is made available. If the request is refused, only the request fee remains payable.
8. Decision on a Request
We will respond to your request within 30 days of receipt. In certain circumstances, this period may be extended by a further 30 days, and you will be notified of any extension and the reasons for it. If your request is refused, we will provide written reasons and advise you of your right to appeal to the courts or lodge a complaint with the Information Regulator.
9. Data Subject Access Requests (POPIA)
Under the Protection of Personal Information Act (POPIA), you have the right to request access to, correction of, or deletion of your personal information that we hold. This is known as a Data Subject Access Request (“DSAR”).
How to submit a DSAR:
- Email your request to [email protected], subject line “Data Subject Access Request”
- Include your full name, the email or telephone number associated with your enquiry, and a description of the personal information you wish to access, correct, or delete
- Provide a copy of your identity document for verification purposes
Our commitment:
- We will acknowledge receipt of your DSAR within 5 business days
- We will respond substantively within 30 business days of receiving a valid and complete request
- If we are unable to comply with your request (in whole or in part), we will provide written reasons
- There is no fee for submitting a DSAR under POPIA

10. Grounds for Refusal
Access to a record may be refused on the grounds set out in Chapter 4 of PAIA, including but not limited to:
- Protection of the privacy of a third party (Section 63)
- Protection of commercial information of a third party or of B&W Productions (Section 64)
- Protection of confidential information of a third party (Section 65)
- Protection of safety of individuals or property (Section 66)
- Records that are privileged from production in legal proceedings (Section 67)
- Protection of research information of a third party (Section 69)
